Alternative Dispute Resolution (ADR)
This intervention is commonly known as
Mediation, even though it is broader than that.
It is outlined in s134 of the National Credit Act
34 of 2005. It is a dispute resolution mechanism that
offers a consumer an alternative to
litigation (court process). The workshop will share
light on what ADR is, its advantages and the
steps to be taken when a consumer has failed to
negotiate with either a credit provider or
debt counsellor or attorney representing a
credit provider or a credit bureau.
Consumer Credit Education
The workshop will assist in improving consumer
behaviour over time, by enhancing and increasing
levels of knowledge, awareness, and borrower
confidence,so that consumers are able to make more
informed and responsible decisions
when borrowing or applying for credit.
Debt Counselling/Debt Review 101
This workshop covers an overview of debt
counselling. It provides answers to critical
questions usually posed by consumers who want
to apply for debt counselling or those
who are already under debt counselling, but
their debt counsellor never divulged certain
pertinent information. Topics include – who
qualifies to be under debt review; how do you
determine whether a consumer is over-indebted
or noa consumer has defaulted in payments;
the debt counselling process; withdrawal from
debt review; debt counselling fees and
other charges. The workshop is a revelation!
National Credit Act and Its Amendments
The workshop will cover an overview of the
National Credit Act; its purpose and the
protection it offers consumers against:
- irresponsible lending by credit providers.
- creditors who over-charge interest and
other fees, especially when a consumer can no
longer afford to make payments.
- Credit agreements or provisions that
are unlawful.
- Agreements that are no longer
enforceable (prescribed)
- Other credit related matters
Garnishee Orders: Employer’s Guide
This workshop is intended for HR and Payroll
personnel in South Africa. Among other issues,
it will shed light on the following: the debt
collection process; relevant legislation
concerning emolument attachment orders; common
pitfalls and loopholes to be avoided; and
recommendations for the proper administration
of emolument attachment orders.
